FTC Makes Moves to Enhance Data Privacy Oversight

The Federal Trade Commission took a few risky steps on Thursday to strengthen its control over data privacy, including launching an effort to codify significant amendments to the Health Breach Notification Rule and issuing a policy statement alerting the public to increased scrutiny of the use of biometric data.

The 2021 policy statement that broadened the commission’s interpretation of the breach notification regulation served as the foundation for the proposed rule-making modifications. The two Republican commissioners, who charged their Democratic counterparts with exceeding the agency’s statutory authority, unanimously opposed the policy statement. Since then, the FTC now has a majority of three Democratic commissioners due to the resignation of both Republican commissioners.
